On 17 October 2018 the Central Election Commission of the Russian Federation held its 186th regular meeting.
On the re-election of the Governor of Primorsky Krai
Opening the meeting, the Chairperson of the Central Election Commission of the Russian Federation Ella Pamfilova said that the situation related to the elections of the Governor of Primorsky Krai is under constant control of the Central Election Commission.
On 16 October 2018 the Primorsky Krai Legislative Assembly in connection with the decision of the Regional Election Commission to recognize the results of early elections of the Governor of Primorsky Krai invalid has appointed the re-election of the Head of the region on 16 December 2018.
The Head of the Central Election Commission noted that the updated electoral legislation of Primorsky Krai allows the subjects of public control to send observers to elections and expressed the hope that “a ‘landing force’ of public observers will be serious and elections will be held under strict public control.”
“All violations that were revealed during the second vote in the elections of the Governor of Primorsky Krai will not be ignored and the perpetrators will be punished,” said Ella Pamfilova. “I hope the Election Commission of Primorsky Krai will make appropriate conclusions.”
On the repeat voting in the elections of the head of the Republic of Khakassia
Ella Pamfilova also noted that the CEC of Russia is closely monitoring the situation in the Republic of Khakassia. “We will keep under control every step you take,” said Ella Pamfilova to the Election Commission of the Republic of Khakassia. “Now we need to triple our efforts to hold the elections and to conduct them properly and professionally. You know how to do it.”
On initiatives for holding the referendum of the Russian Federation
The Secretary of the CEC of Russia Maya Grishina said that in case of registration of regional sub-groups in more than half of the Subjects of the Russian Federation, authorized representatives of regional sub-groups of more than half of the Subjects of the Russian Federation shall be entitled to adopt at their meeting a decision to appeal to the CEC of Russia with the petition for the registration of an initiative group on referendum. If within two months from the date of registration of the first initiative subgroup the application for registration of the initiative group is not submitted, the CEC of Russia makes the decision on the termination of procedures for implementation of the initiative for conducting the referendum.
The CEC of Russia decided to terminate the procedures on the initiative for the referendum of the Russian Federation on five questions previously recognized as relevant to the requirements of the Federal constitutional law of 28 June 2004 No. 5-FKZ “On the referendum of the Russian Federation” due to the fact that within two months from the date of registration of first regional subgroups the CEC of Russia has not received a request for registration of the initiative group for the referendum on any of these questions.
Ella Pamfilova noted that when the CEC of Russia received notifications from regional election commissions on questions specified in the applications for registration of regional subgroups of initiative groups for the referendum of the Russian Federation it worked quickly, providing equal starting opportunities to all initiators.
“It was a very useful experience,” said Ella Pamfilovad. “When a real possibility of a referendum appeared, we took all necessary measures and were ready to hold it. The CEC of Russia will continue this work in the future.”
On explanations and instructions of the CEC of Russia during the conduct of a referendum of the Russian Federation
The member of the CEC of Russia Yevgeny Shevchenko explained that the Central Election Commission of the Russian Federation is working on the preparation of regulations related to the Federal Constitutional Law No. 5-FKZ “On the referendum of the Russian Federation.” “The preparation of documents is planned and is not connected with holding of any referendums,” said Yevgeny Shevchenko.
The Central Election Commission of the Russia Federation approved the forms about the inspection of the information indicated by individuals and legal entities when making (transferring) voluntary donations to the funds of the referendum and reports about the results of this audit during the referendum of the Russian Federation, as well as Explanation of the order of the registration and activities of authorized representatives on financial questions of the initiative group on holding a referendum, an initiative campaign group at the referendum of the Russian Federation; Instruction on the procedure and forms of accounting and reporting of the initiative group for the referendum, an initiative campaign group on the receipt of funds to the funds of the referendum and the expenditure of these funds during the referendum of the Russian Federation.
In addition, the CEC of Russia decided to adopt a draft resolution of the Central Election Commission of the Russian Federation “On the Procedure for opening, maintaining and closing of special accounts of the referendum funds of the initiative group for the referendum, the initiative campaign group during the referendum of the Russian Federation.”
